LPK Lead Paint Attorneys Win Lead Poisoning Liability Lawsuit for 4.6 Million Dollars

LPK Attorneys Alan J. Konigsberg and Daniel J. Woodard obtained a verdict totaling $4,645,000.00 in a lead paint poisoning liability lawsuit on the behalf of a child who was 15 years old at the time of trial and 4 years old when he was poisoned from his apartment building's lead paint. Attorneys substantiated the lead paint lawsuit by showing that for a period of approximately one year, while residing in a Manhattan apartment building, the child was exposed to peeling and chipping lead based paint and lead based paint dust. Attorneys then went on to argue the apartment owner and manager's liability for the lead poisoning.

The jury agreed with the lead paint attorneys by concluding that the corporate owner and manager of the apartment building were negligent in failing to maintain the apartment in accordance with the Laws of the State and City of New York. The jury also agreed with the lead paint attorneys that lead poisoning liability should been place on the owner of the building because the owner had been aware of a lead paint hazard in the building, by virtue of the Department of Health's issuance of lead paint violations against the owner, 10 years prior to the infant plaintiff moving into the apartment building. The jury also found that the infant's lead poisoning was a substantial factor in causing his cognitive, attention, and learning deficits, one of the lead paint lawsuit's main arguments for filing for compensation.

As a result of his lead poisoning, the lead paint lawsuit went on to explain how the infant failed the third grade, had to repeat the third grade and had failing grades in most of his major subjects through the 8th grade. The plaintiff also suffers from learning disabilities, caused by the lead poisoning, which have resulted in his far below average academic performance. The case was tried in the State of New York, Kings County. Lead paint attorneys Levy, Phillips and Konisberg represented the child and won the $4.6M verdict.
