For over 6 years, while residing in a Manhattan apartment building, the 11-year-old boy was exposed to peeling and chipping lead based paint and lead paint dust. The 9-year-old boy was exposed to the hazardous lead paint condition for over 4 years while residing in the same Manhattan apartment. The jury concluded that the owner of the apartment building was negligent in failing to maintain the apartment in accordance with the Laws of the State and that the infants’ lead poisoning was a substantial factor in causing their cognitive, intellectual and behavioral deficits. As a result of the lead poisoning, the infant plaintiffs' failed the first grade and continue to perform poorly academically. They also suffer from ADHD and other learning disabilities. The case was tried in New York State Court, New York County. Verdict totalling $6,900,000.
